What is litigation?

Litigation can be defined as that succession of acts aimed at the judicial defense of certain legal claims before a court that knows and resolves a dispute between one or more parties.

What is administrative litigation?

Administrative litigation is one that normally occurs between individuals and organs or agencies of the state administration , the most frequent examples are disputes arising from the granting of permits or administrative sanctions on individuals or companies (such as fines), administrative contracting , administrative sanctioning law (mentioned above), expropriation , State responsibility and others.

Administrative Litigation Courts?

Despite the undeniable importance that administrative law plays day by day, not only for the organs of the State Administration , but especially for individuals - in matters such as administrative contracting , administrative sanctioning law , expropriation , State responsibility , administrative powers regulating the economy, etc.-, the creation of a specialized judiciary , with broad jurisdiction, to hear administrative contentious cases is strange. Said possibility, considering the wording of the constitutional provision contained in article 38, paragraph 2 of the Fundamental Charter , is fully in force and delivered to the legislator.
